· Gained the Freedom of the City of London as Citizen and Clothworker by the patrimony of his father Thomas Reynolds. · There were six children by his first marriage to Elizabeth: Mary (1759-1807), Elizabeth (1760-1787), Thomas (1761-1819), Susannah (1765-1807), Ann (1766-1839) and William Foster (1767-1838), there were two children by his second marriage to Deborah: Jacob Foster (1775-1851) & Deborah (1776-1874). · The will appears to provide and equitable distribution between his children from both marriages and provisions for wife Deborah Reynolds limited to during her life. · The references to Trusts in the hands of Ackworth School and the London Meeting would suggest that previous arrangements included loans or stock given to each of them providing a small interest in return. · A Tumbling Bay can be a fixed crest weir possibly intended to create a mill pond resource and could include sluice gates to release water when necessary. |

I Foster Reynolds of Carshalton in the County of Surry Linen Bleacher being of sound and disposing mind and memory do make publish and declare this my last will and Testament in manner and form following Viz’t I desire and direct that all my just Debts and engagements including my Funeral Expences may be paid as soon as convenient after my decease Item I give devise and bequeath unto my dear Wife Deborah Reynolds for and during the term of her natural life all that my Freehold new erected Dwelling house with the Outhouses and offices attached or detached with all and singular the Appurtenances thereunto belonging or in any wise appertaining with the yard Gardens Garden Walls Greenhouse Greenhouse Plants new erected Vineary Orchard Lawn before the house and the Field behind the same enclosed by and Oak paling extending from the upper corner of the said Field down to the River with all the Fruit Trees and other Trees Shrubs and Plants contained within or about the said Boundary with liberty of free Ingress and egress through all and every part of the adjoining premises now in my possession together with the Coach houses and three stall’d Stable situate in the yard adjoining to the new erected drying loft all which said house and premises are situate in the Parish of Carshalton in the County of Surry And from and after the decease of my said Wife Deborah I give devise and bequeath the same and every part thereof unto my Son Jacob Foster Reynolds to him and his Heirs for ever but if my said Son Jacob Foster should depart this life without lawful Issue I give devise and bequeath the same to my Son William Foster Reynolds his Heirs and Assigns for ever Item I give devise and bequeath to my Son Thomas Reynolds and to my Son Jacob Foster [page break] Reynolds as tenants in common and not as joint tenants all that my Freehold Estate situate lying and being in the several parishes of Carshalton and Wallington in the County of Surry consisting of houses Outhouses Barn Stable Granary Corn Mill and various other Buildings with the Lands and premises thereunto belonging except and reserved out of the demise what is bequeathed to my dear Wife Deborah for and during her natural life and after her decease as is therein appointed I give the said Lands and premises aforesaid with the above exception to them their Heirs and Assigns for ever subject nevertheless to the Rent charge hereinafter mentioned to be deducted from the Bleaching Trade as is therein expressed Item I give devise and bequeath to my Son William Foster Reynolds all that my Freehold Estate situate lying and being in the Parishes of Carshalton and Bedington in the County of Surry aforesaid consisting of Water Leather Mills lands and premises in the tenure of Pillet Savignac and Water Corn and Logwood Mills in the possession of the said William Foster Reynolds to him and his Heirs for ever I give to my Grandson Foster Reynolds one hundred pounds to be paid into his father William Foster Reynolds’s hands which I request he will please to place out in good security upon Interest and pay the same to him when of age Item I give to my said dear Wife Deborah Reynolds four thousand pounds Item I give to my Executors hereinafter named eight thousand pounds upon the following Trusts Viz’t To pay the Interest of Four thousand pounds being one half of the said eight thousand pounds to my Daughter Mary for and during her natural life if she shall remain single and unmarried but in case of her marriage I order and direct my said Executors to pay two thousand pounds to my said Daughter on her day of Marriage the other two thousand pounds to be secured in Trust and settled upon my said Daughter Mary and the Heirs of her body But if she should happen to die leaving no Issue i then direct that the said Two thousand pounds shall revert to my Executors upon the Trusts hereinafter mentioned I also direct that my said Daughter Mary if she should remain single and unmarried may leave and dispose of by Will or otherwise all or any part of the Two thousand pounds first mentioned The other two thousand pounds to be disposed of as hereinbefore [page break] directed in case of her death without Issue in like manner I direct my Executors to pay the Interest of the other four thousand pounds to my Daughter Susannah for and during her natural life if she shall remain single and unmarried but in case of her Marriage I hereby direct my Executors to follow the same rule as is hereinbefore directed for my Daughter Mary with the with the liberty of disposing of two thousand pounds by will or otherwise the remainder if any subject to the like Contingency And as to the Contingency of the said two thousand pounds after the death of either or both of my said Daughters Mary and Susannah so dying single or without Issue I direct my Executors hereinafter named to dispose thereof in manner following I give to the Committee and Trust for Ackworth School five hundred pounds for the benefit of that Institution I give to my Nephew James Reynolds five hundred pounds I give to my Nephew Henry Reynolds five hundred pounds I give to my Nephew Richard to my daughter Ann now the Wife of Thomas Woodrouffe Smith Two thousand pounds I also give to her two daughters Ann and Maria one hundred pounds each to be paid into their fathers hands within one year after my decease which I request he will place out at Interest for their use to be paid to them when of age or married with benefit of Survivorship Item I give and bequeath to my Son Jacob Foster Two thousand pounds to be paid to him at the age of twenty one years the Interest whereof at the rate of Five pounds per Cent per Annum in the meantime to be paid to his Mother for his Cloathing maintenance and support which I direct may be left to her discretion and that she shall not br accountable to him or any of my Executors for the expenditure of the surplus of such Interest money [page break] but may take it to her own use I direct that he Bleaching Trade shall be continued and carried on for the benefit of this Estate and to enable my Executors to pay and discharge the respective Legacies and Interests that shall from time to time become due and payable and I also direct that my said Son Jacob Foster shall when out of his apprenticeship be considered as a co-partner in the said Business and that his Legacy of Two thousand pounds shall be considered to be and be his share and Interest in that Stock and Trade And I direct that from and after the first day of the first Month of the succeeding year after my decease my eldest Son Thomas to whom I have given a Bond for Two thousand pounds bearing date the first day of the first Month one thousand seven hundred and eighty four to secure to him what was then a proportionate share of my Effects with his Brothers and Sisters shall be intitled to one half of the Profits of the said Bleaching Trade my Son Jacob Foster in like manner to be intitled to the other half of the said Profits when out of his apprenticeship to commence the first day of the first Month next succeeding that period And I direct that an annual Rent of Four hundred pounds shall be first deducted from the said Business and paid to my Executors to pay ^the same^ to my dear Wife for and during her natural life and from and after her decease I leave the said four hundred pounds per Annum to my two Sons Thomas and Jacob Foster I also give and devise to my Executors In Trust all my Leasehold Estates at Mitcham subject to the Payment hands within one year after my decease who I request will place it out in good security to be paid to them when of age And whereas I have lately made a purchase of certain Leasehold Lands and premises in Wallington late in the possession of William Tegg James Whitehead and William Nate Callico Printers and now part thereof let to the said William Nate upon Lease I give and bequeath the whole and every part of the said Leasehold Estate to my Executors in Trust to sell and dispose of the same to the best bidder allowing my Son Thomas Reynolds the preference of purchasing the same if he shall be for it I give to the Monthly Meeting of Kingston Wandsworth and Croydon fifty pounds for the relief of the poor of the said Meetings jointly but not separately earnestly recommending to my dear the eldest having the first choice taking one or two or more volumes if compleat and each of the others in turn in like manner and number and so on till the whole are divided I give to my Son Jacob Whereas when I made and duly executed my Will and Testament on or about the eighteenth day of the third Month 1796 I omitted to mention Cows and Cowhouse which belong to me now I do hereby declare my mind and will concerning the same I give and bequeath all my Cows heifers and Calves to my dear Wife with the free and full use of the Cowhouse and yard and all that appertains thereunto Also the Cow or Calf Crib that now stands in the stake house at the back of the Stable and Coach houses which stake house is a part of the said building which is mentioned in my said Will I also give to my said dear Wife Deborah Reynolds the hen house with all the Poultry Hens and Cocks Ducks and Drakes with all and every the appurtenances belonging to the dwelling house as by my Will is expressed And I also request my Executors named in my said Will [page break] will take upon them the due execution hereof Witness my hand this 16th. day of 8th. A Codicil to be annexed to my Will Whereas by my last Will and Testament dated y’e 18th. day of the 3’d Month 1786 I have given among other bequests to my Son W’m Foster Reynolds certain Mills and premises now in the tenure of him the said W’m Foster Reynolds and Pillet Savignac nevertheless the said bequest is upon this Condition that as it appears ^quite necessary that^ a tumbling bay should be erected upon the River head of Pillet Savignac of the full length of eighty feet or upwards and at such height as three judicious men shall agree to be proper with a view to the eventual Interest of each and every person interested therein with full and free liberty for my Sons Tho’s and Jacob Foster Reynolds to claim such parts of the said River when and as often as may be necessary and to order the said Mills to draw their Gates for such purpose at least three times every year giving two days notice to the Mill holder My will and desire is with a view to the preservation of Love and Harmony among Brethren that the said erection of a tumbling bay should be executed as soon as is convenient at the joint expence of the said three Brothers each paying their respective shares ~ Carshalton 1st. Whereas I have purchased several pieces or parcels of Land of Henry Byne which are not yet wholly completed with respect to the full payment thereof My will and desire is that the said pieces of Land Including the Furze Field let on Lease to William Simarly be annexed to and belong to the premises given by ------ Will to my Sons Tho’s and Jacob Reynolds they paying and compleating the said purchase ~ Foster Reynolds Carshalton 1st. Mo. 27th. 1797 ./.
Carshalton 1st. Mo: 28th. 1797 Considering it has pleased almighty God to extend my life beyond the time I had in expectation when I made my Will dated [page break] 3’d Mo 18th. 1796 at that time my Son Jacob Foster was neither of age nor out of his apprenticeship it is now my present Will and direction that whenever it shall please God to call me from the stage of life that my two Sons Thomas and Jacob Foster Reynolds shall be equally intitled to the whole profits of the bleaching Business from the 1st. of 1st. Mo. 1796 Subject nevertheless to the Rents charged on said Business for the same specified time And I recommend my two Sons aforementioned to have a fair and true valuation to be taken and made of the Stock in Trade and utensils employed therein by two proper persons judges thereof and entered in two separate Books to be kept by the two Brothers for their private ^use and^ satisfaction ~ Foster Reynolds ./.
As I have p’d to Martha Hayes her Legacy of £20 I desire my Executors will please pay ten pounds to Mary Edwards who now lives in my Family in the place Of Martha Hayes ~ Foster Reynolds 7th. Mo. 10th. 1797.
18th. January 1798 On which day appeared personally Herman Schroder of College Hill London Sugar Refiner and Herman Schroder of the same place Sugar Refiner and made oath that they knew and were well acquainted with Foster Reynolds late of Carshalton in the County of Surry for several years before and to the time of his death which happened in the Month of December last and during such their knowledge of and acquaintance with him the said deceased they have often seen him write and subscribe his name and were and are thereby become well acquainted with his manner and character of handwriting and subscription and having now carefully viewed and perused the paper writings hereunto annexed purporting to be the last Will and Testament with five Codicils annexed of the said deceased the first of the said Codicils beginning thus “Whereas when I made & duly executed my Will and Testament on or about the eighteenth day of the third Month 1796” ending thus “Witness my hand this 16th. day of 8th. Month 1796” and thus subscribed “Foster Reynolds” the third of the said Codicils beginning thus “Whereas I have purchased several pieces or parcels of Land of Henry Byne” ending thus “they paying and compleating the said purchase” and thus subscribed “Foster Reynolds” and dated “Carshalton 1st. Mo: 27th. 1797^ ^the fourth of the said Codicils beginning thus “Carshalton 1st. Mo 28 1797^ ^considering it has pleased almighty God to extend my life” ending thus “two Brothers for their own [page break] private use & satisfaction” and thus subscribed “Foster Reynolds” and the firth of the said Codicils beginning thus “as I have paid to Martha Hayes her Legacy of £20” ending thus “Mary Edwards who now lives in my Family in the place of Martha Hayes” and thus subscribed “Foster Reynolds” they these deponents do jointly and severally depose that they do verily and in their Consciences believe the whole body series and Contents of the said Codicils and the several subscriptions thereto to be all of the proper handwriting and subscription of the said Foster Reynolds the Testator deceased ~ Herman Schroder ~ Herman Schroder jun’r ~ The same day the said Herman Schroder was duly sworn to the truth of this affidavit Before me S Parsons Surr pres’t Rich’d Addams Not Pub ./. ----------------------------------- ~ On the 19th. This Will was proved at London with five Codicils the twenty third day of February in the year of our Lord one thousand seven hundred and ninety eight before the Worshipful Christopher Robinson Doctor of Laws Surrogate of the Right Honourable Sir William Wynne Knight also Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by Thomas Woodrouffe Smith William Foster Reynolds the Son of the deceased and Samuel Brady three of the Executors named in the said Will to whom administration was granted of all and singular the Goods Chattels and Credits of the said deceased they having already made a solemn and sincere declaration or affirmation according to Act of Parliament duly to administer Power reserved of making like grant to Deborah Reynolds Widow the Relict of the said deceased and other Executor named in the said Will when she shall apply for the same. |
